Help With Spousal Support Issues

At Lite DePalma Greenberg & Afanador, the attorneys understand the statutes and factors that go into a request for an alimony payment and how to best advance your argument for, or against, the request. The attorneys look at your individual circumstances versus what the state expects when a couple separates and evaluate your situation to see whether or not the request should be granted by the courts.

Defining What Alimony Is

The state statutes give the courts jurisdiction to grant different types of alimony depending on the individual’s circumstances. There are no guidelines for calculating the amount of money paid; instead it is decided on a case-by-case basis pursuant to 11 different statutory factors, including income of the parties, lifestyle of the parties, length of the marriage and equitable distribution. The types of alimony are as follows:

  • Lifetime alimony: Regular payments until death or remarriage.
  • Rehabilitative alimony: Temporary payments until certain terms are met, such as obtaining employment to become self-supporting.
  • Limited duration alimony: Regular payments for a certain duration of time.

Legal Representation During Alimony Requests

The New Jersey spousal support attorneys will analyze your finances and lifestyle to help you determine how much alimony you require. The attorneys will advocate on your behalf in support of your alimony needs.

Disputing The Need For Alimony

If you are faced with a potential alimony obligation, which you believe to be unfair in its amount or duration, the attorneys will examine the facts of your case and develop strategies to support your arguments.
